Terms and Conditions for MyBuild

 

These Terms and Conditions ("Terms") govern your use of MyBuild, operated by Easie Ltd ("Company," "we," "us," or "our"). By accessing or using MyBuild, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use MyBuild.

 

1. Services

 

1.1. MyBuild provides both a free and subscription-based service  ("Services") on a daily, weekly and monthly basis. If you choose to subscribe for a paid plan (as described on our website www.mybuild.io/plans), you agree to pay the applicable subscription fees.

 

1.2. We reserve the right to change subscription fees upon prior notice to you. If you do not cancel or downgrade your subscription your continued use of the Services after such changes constitute your acceptance of the new fees.

 

1.3 We will provide at least 30 days prior notice of any price change.

 

2. User Accounts

 

2.1. In order to access and use MyBuild you must create an account and provide accurate and complete information.

 

2.2. You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

 

2.3 To create an account you must be, and you represent and warrant that you are, at least 16 years of age and competent to agree to these Terms.  If the law where you reside requires that you must be older in order for Easie Ltd  to lawfully provide the Service and Websites to you and use your personal data without parental consent, then you must be that older age.

2.4 You are responsible for notifying us at hi@mybuild.io if you become aware of any unauthorized use of or access to your account.  You understand and agree that we may require you to provide information that may be used to confirm your identity and help ensure the security of your account.  Easie ltd will not be liable for any loss, damages, liability, expenses or fees that you may incur as a result of someone else using your password or account, either with or without your knowledge and/or authorization, and regardless of whether you have advised us of such unauthorized use.  You will be liable for losses, damages, liability, expenses and attorneys’ fees incurred by Easie Ltd or a third party due to someone else using your account. 

 

 

 

 

3. Use of the app and website

 

3.0 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, non-transferable, and revocable right to access and use the Service and Websites only for your use in a manner that complies with these Terms and all legal requirements that apply to you or your use of the Service.  Easie Ltd may revoke this license at any time, in its sole discretion.

 

 

3.1. You agree to use MyBuild only for lawful purposes and in accordance with these Terms.

 

3.2. You may not use MyBuild  in any manner that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use of the Services.

 

3.3 You may not use MyBuild in any way that breaches any applicable local, national or international law or regulation

 

3.4 You may not use MyBuild In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect. You may not post user content on the Service in a manner that: is deceptive, fraudulent, illegal, obscene, defamatory, disparaging, libellous, threatening, or pornographic; criticizes others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition; contains any personal information of minors under the age of 16;contains any sensitive personal information as defined by applicable law; contains viruses, bots, worms, or similar harmful materials; 

 

 

4. Data Protection and GDPR Compliance

 

4.1. We are committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

 

4.2. We collect, process, and store personal data in accordance with our Privacy Statement, which forms part of these Terms. By using Mybuild you consent to the collection, processing, and storage of your personal data as described in our Privacy Statement.

 

4.3. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including the pseudonymization and encryption of personal data, to ensure confidentiality, integrity, and availability of the data.

 

5. Intellectual Property

 

5.1. All intellectual property rights in MyBuild and its contents, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to the Company.

 

5.2. You may not copy, reproduce, modify, distribute, display, perform, or transmit any part of MyBuild without our prior written consent.

 

6. Limitation of Liability

 

THE SERVICE AND WEBSITES AND USER CONTENT, WHETHER PROVIDED BY EASIE LTD, ITS LICENSORS, ITS VENDORS OR ITS USERS, AND OTHER INFORMATION ON OR ACCESSIBLE FROM THE SERVICE AND WEBSITES ARE PROVIDED “AS IS” WITHOUT WARRANTY, REPRESENTATION, CONDITION, OR GUARANTEE OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES, REPRESENTATIONS, CONDITIONS OR GUARANTEES OF QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ALL OF WHICH ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.  SPECIFICALLY, BUT WITHOUT LIMITATION, EASIE LTD DOES NOT WARRANT THAT: (i) THE INFORMATION AVAILABLE ON THE SERVICE AND WEBSITES IS FREE OF ERRORS; (ii) THE FUNCTIONS OR FEATURES (INCLUDING BUT NOT LIMITED TO MECHANISMS FOR THE DOWNLOADING AND UPLOADING OF USER CONTENT) WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS; (iii) DEFECTS WILL BE CORRECTED, OR (iv) THE SERVICE AND WEBSITES OR THE SERVER(S) THAT MAKE THE SERVICE AND WEBSITES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  EASIE LTD DOES NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICE AND WEBSITES OR ANY WEBSITE FEATURED OR LINKED TO THROUGH THE SERVICE AND WEBSITES, AND EASIE LTD WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICE AND WEBSITES.  EASIE LTD WILL NOT BE LIABLE FOR THE OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY.  YOU VOLUNTARILY ASSUME THE RISK OF HARM OR DAMAGE FROM THE FOREGOING.  THE FOREGOING LIMITATIONS WILL APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND TO THE FULLEST EXTENT PERMITTED BY LAW.

IN NO EVENT SHALL EASIE LTD EXECUTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR COSTS OF OBTAINING SUBSTITUTE GOODS OR SERVICES), ARISING OUT OF OR IN CONNECTION WITH THE SERVICE AND WEBSITES, ANY MATERIALS, INFORMATION, OR RECOMMENDATIONS APPEARING ON THE SERVICE AND WEBSITES, OR ANY LINK PROVIDED ON THE SERVICE AND WEBSITES, WHETHER OR NOT EASIE LTD  HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER BASED UPON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, VIOLATION OF STATUTE, OR OTHERWISE.  THIS EXCLUSION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD EASIE LTD , ITS AFFILIATES, AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS, CONTRACTORS, OR REPRESENTATIVES HARMLESS FROM AND AGAINST ANY CLAIM OR DEMAND, INCLUDING WITHOUT LIMITATION, REASONABLE LEGAL FEES, MADE IN CONNECTION WITH OR ARISING OUT OF YOUR USE OF THE SERVICE AND WEBSITES, YOUR CONNECTION TO THE SERVICE AND WEBSITES, YOUR VIOLATION OF THE TERMS, YOUR VIOLATION OF AN APPLICABLE LAW, YOUR SUBMISSION, POSTING, OR TRANSMISSION OF USER CONTENT TO THE SERVICE AND WEBSITES, AND/OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER INDIVIDUAL OR ENTITY.  WE RESERVE THE RIGHT TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF SUCH DISPUTES, AND IN ANY EVENT YOU WILL COOPERATE WITH US IN ASSERTING ANY AVAILABLE DEFENSES.

 

 

 

8. Governing Law

 

8.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.

 

9. Changes to the Terms

 

9.1. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website or mobile application.

 

10. Entire Agreement & No Waiver

 

These Terms (and all terms and conditions incorporated herein) constitute the entire agreement between you and Easie Ltd , and supersede any prior agreements between you and Easie Ltd on the subject matter. The failure of Easie Ltd to exercise or enforce any right or remedy in these Terms does not waive that right or remedy.  If any provision of these Terms is found to be invalid or unenforceable, the parties agree that the court should endeavour to give effect, to the maximum extent permitted by law, to the parties’ intentions as reflected in the provision, and the other provisions of these Terms will remain in full force and effect.
